These terms and conditions (“Terms and Conditions”) govern the relationship between Couture Reservations, LLC  (“We/Us/Our" and "Company") and you, the purchaser or travel (“Client” and “Passenger” and “You/Your”). By planning travel with Couture Reservations, LLC, you agree to be bound by these terms and acknowledge that We act solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services.  These terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to Couture Reservations, LLC.

RIGHT TO CORRECT ERRORS AND OFFERS SUBJECT TO AVAILABILITY

We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives and Supplier promotions are subject to availability and may change without notice. You are advised to confirm reservations well in advance of your anticipated dates of travel to avoid disappointment, increases in fares and additional late booking fees.

TRAVEL DOCUMENTS

In order to book international travel with Couture Reservations, LLC, each individual Client agrees to ensure their passport remains valid for a minimum of six months beyond the date of travel.  Each Client is fully responsible for obtaining and verifying all essential travel documents, including passports, visas, health certificates, vaccinations, and any other required permits before their departure.  Couture Reservations, LLC will not be held responsible for any adverse consequences arising from a Client's failure to comply with travel document requirements.  It is of the utmost importance that each Client adheres to the guidelines to facilitate a seamless and enjoyable experience.

 

It is the responsibility of each Client to obtain and carry a valid passport book, visa(s), and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS)advise that everyone carry acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/ and examples include DHS-designated enhanced driver’s license, US passport, or a foreign government passport.

 

The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on your tickets and booking records. You acknowledge that it is your responsibility to ensure that the information on your tickets and confirmations is accurate. Any discrepancy between your reservation and your travel documentation may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss your flight, and any subsequent scheduled travel bookings on cruises and tours. 

 

WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT TALES OF A TRAVEL BAG IMMEDIATELY IF CHANGES OR CORRECTIONS ARE REQUIRED. IF YOU HAVE NOT NOTIFIED US OF NECESSARY CORRECTIONS TO YOUR RESERVATION WITHIN TWENTY-FOUR (24) HOURS OF RECEIVING YOUR TRAVEL DOCUMENTS, COUTURE RESERVATIONS, LLC BEARS NO RESPONSIBILITY FOR ANY ADDITIONAL COSTS ASSOCIATED WITH MAKING NECESSARY CORRECTIONS.

 

TRAVEL PARTY OF TWO OR MORE 

For travel arrangements involving more than one individual,  the term  "Group" and "Party" refers collectively to all individuals included in the booking.  Each member of the Party is responsible for ensuring their passport remains valid for a minimum of six months beyond the date of travel, and for obtaining and verifying all essential travel documents, including passports, visas, health certificates, vaccinations, and any other required permits before departure.

Couture Reservations, LLC will not be held responsible for any adverse consequences arising from the failure of any member of the Party to comply with these travel document requirements.  It is the responsibility of the Party organizer to communicate these guidelines to all members of the Party and ensure their adherence to them.

 

GROUP BOOKINGS

For Group Bookings arranged by Couture Reservations, the term "Client" refers to the group organizer or representative who is responsible for coordinating the booking on behalf of the Party.  The group organizer is responsible for ensuring all members of the Party meet the necessary travel document requirements, including passport validity, visa regulations, health certificates, vaccinations and any other required permits or documentation.

Couture Reservations will not be held responsible for any sadverse consequences arising from the failure of any member of the Party to comply with these requirements.  It is the responsibility of the Party organizer to communicate these guidelines to all members of the Party and ensure their adherence to them.

 

TRAVEL ADVISORIES

Couture Reservations, LLC will make reasonable efforts to advise the Client to regularly check travel advisories issued by the U.S. Department of State and any other relevant sources for updated information on travel restrictions, warnings, and alerts for their destination.

The Client acknowledges that it is their sole responsibility to stay informed about travel advisories and to assess the risks associated with their travel destination.  Couture Reservations, LLC strives to provide accurate information, however, it is the sole responsibility of the Client to stay informed about any existing advisories.  The Client agrees to independently check travel advisories prior to booking, before and during travel.  Couture Reservations, LLC shall not be held liable for any consequences resulting from the Client's failure to heed travel advisories or warnings issued by authoritative sources.  

The Client acknowledges that Couture Reservations, LLC provides recommendations and guidance based on available information, but are not responsible for the actions or decisions of the Client in relation to travel advisories.

Couture Reservations, LLC shall not be liable for any consequences resulting from the Client choosing to travel against the advisories listed by authoritative sources, including but not limited to:

Travel disruptions or cancellations due to  sudden changes in regulations or entry requirements may result in additional expenses for the client, such as rebooking fees, accommodation costs, or alternative transportation expenses.

Financial losses incurred from non-refundable bookings or cancellations due to travel advisories may include costs associated with flights, accommodations, tours, or other prepaid expenses that are not reimbursed by travel insurance or service providers.

Medical expenses or emergencies arising from travel to areas under travel warnings or restrictions may require costly medical treatment, hospitalization, or evacuation, which may not be covered by the Client's travel insurance or may result in out-of-pocket expenses.

Legal issues or complications related to non-compliance with local regulations or restrictions may result in fines, penalties, deportation, or legal proceedings, which may incur significant expenses for the client, including legal fees, fines, or compensation payments. 

 

CHANGES TO ITINERARY

In the event of changes to the Client's travel itinerary, including but not limited to changes in travel dates, destinations, or accommodations, the Client should promptly inform Couture Reservations, LLC.  Changes are subject to availability and the policies of the respective service providers, and additional fees may apply.

Couture Reservations, LLC will make reasonable efforts to accommodate the Client's requested changes, but cannot guarantee availability or the ability to make changes without the Client incurring additional costs.

The Client acknowledges that changes to the itinerary may result in additional expenses, including but not limited to rebooking fees, fare differences, or penalties imposed by service providers.  

Couture Reservations, LLC shall not be held liable for any financial losses or inconvenience incurred by the Client as a result of changes to the itinerary, including but not limited to non-refundable bookings, missed connections, or other related expenses.  It is the Client's responsibility to carefully review and understand the terms and conditions of their booking.

 

LIABILITY

Couture Reservations, LLC acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service.   While we make every effort to ensure the accuracy and quality of the services offered, we are not liable for any injury, loss, damage, or inconvenience caused by third party service providers, including but not limited to airlines, hotels, transportation companies.

The Supplier may determine that alterations in itinerary are necessary for any number of reasons, including but not limited to severe weather. Any alterations to an itinerary are at the sole discretion of the Supplier, and Couture Reservations, LLC bears no responsibility for any changes. 

 

BECAUSE TTB ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT COUTURE RESERVATIONS, LLC IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. COUTURE RESERVATIONS, LLC HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH COUTURE RESERVATIONS, LLC, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATION AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, OR CESSATION OF OPERATIONS AND OTHER MATTERS OUTSIDE OF THE CONTROL OF COUTURE RESERVATIONS, LLC, AND YOU HEREBY EXONERATE COUTURE RESERVATIONS, LLC FROM ANY LIABILITY WITH RESPECT TO THE SAME.

COUTURE RESERVATIONS, LLC HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM COUTURE RESERVATIONS, LLC WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY COUTURE RESERVATIONS, LLC.

Any claim against Couture Reservations, LLC must be brought within 12 months after the date of the completion of the trip and not later. Couture Reservations, LLC shall not, in any case, be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages. You agree that you may only bring claims in your individual capacity and not as plaintiffs or class members in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. You expressly agree to waive and forego any and all rights to bring any such class actions, purported or proposed class actions, or representative actions. 

 

CHILDREN

All children under 18 must be accompanied by an adult.  Accompanying adults are responsible for the safety of their children including providing any necessary safety equipment (such as infant/child seats) where appropriate.  If a person under the age of 18 years will be travelling with an adult other than his/her parents, or with only one parent, a notarized letter written by the parents, or non-travelling parent, granting authorization to travel, including the dates of travel should be carried. 

 

FORCE MAJEURE

Couture Reservations, LLC will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of Couture Reservations, LLC. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.

In addition, each Supplier of Couture Reservations, LLC have terms and conditions which include Force Majeure provisions. In the event that a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier pursuant to their policies, although Couture Reservations, LLC shall use its reasonable efforts to secure reimbursement for you where possible.
