TERMS & CONDITIONS
These terms and conditions (“Terms and Conditions”) govern the relationship between Couture Reservations, LLC (“We/Us/Our" and "Company") and you, the purchaser or travel (“Client” and “Passenger” and “You/Your”). By planning travel with Couture Reservations, LLC, you agree to be bound by these terms and acknowledge that We act solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services. These terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to Couture Reservations, LLC.
CLIENT EXPECTATIONS
The Client is expected to provide accurate and complete information regarding travel preferences, contact details, and any other necessary data to facilitate the booking process.
The Client should review and verify all travel documents, itineraries, and bookings provided by Couture Reservations for accuracy and inform the Agent promptly of any discrepancies.
The Client is encouraged to be financially responsible and will not hold Couture Reservations liable for any hardships incurred by the travel arrangements made by Couture Reservations, LLC.
The Client accepts responsibility for any damage or loss caused by Client. Full payment for any such damage or loss(reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner or manager or other Supplier. You must indemnify Couture Reservations, LLC for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a guest removed from a trip, or any portion of a trip. You agree not to hold Couture Reservations, LLC or any of its related entities liable for any actions taken under these terms and conditions. Baggage and personal effects are at all times the sole responsibility of the participant.
Any transportation, possession or use of illegal drugs will result in immediate termination of your trip and may result in prosecution by law enforcement authorities. You are responsible for knowing and observing the licensing laws for drug possession (including prescription and over the counter drugs) for all countries and states you are visiting. Laws may require you to carry a prescription from your doctor.
TRAVEL PLANNING FEE & PURPOSE
At the discretion of Couture Reservations, LLC, a travel planning fee may be charged to cover the cost of research, planning, and trip management services provided to the Client before or during travel. The travel planning fee is non-refundable should the Client choose to revise or cancel the trip after the initial down payment to the supplier(s) has been made to secure the trip.
The purpose of the travel planning fee is to compensate the Couture Reservations, LLC for the time and effort invested in creating personalized travel itineraries, conducting research, and organizing various components of the trip. This fee helps ensure that our clients receive the highest level of dedication and attention to detail during the planning phase.
In the event the initial proposal is not secured with a minimum deposit, an additional travel planning fee may be requested for initiating a second planning phase.
The travel planning fee is non-refundable regardless of the acceptance or rejection of proposed travel itinerary. The Client acknowledges and accepts the terms regarding the non-refundable travel planning fee for research and planning.
Couture Reservations, LLC is committed to providing exceptional travel experiences. The travel planning fee ensures dedication and attention to detail for the curation of a tailored and memorable experience for our clients.
RIGHT TO CORRECT ERRORS AND OFFERS SUBJECT TO AVAILABILITY
We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives and Supplier promotions are subject to availability and may change without notice. You are advised to confirm reservations well in advance of your anticipated dates of travel to avoid disappointment, increases in fares and additional late booking fees.
BOOKING AND PAYMENT
The Client will be required to pay a minimum deposit at booking to secure and guarantee pricing. All prices are subject to change until a minimum deposit has been paid to the supplier(s).
Couture Reservations, LLC will not be held liable for the difference in cost due to the expiration of a promotion prior to the minimum deposit being secured.
Couture Reservations, LLC requests the Client to remit the payment either in full or a specified deposit, as agreed upon with the travel service supplier, for the requested travel services. Payments can be made using approved payment methods.
Clients are given the option to split the payment(s) on multiple credit cards according to the total value of the trip.
The Client understands failure to make timely payments may result in the cancellation of reservations or bookings without any liability held by Couture Reservations, LLC.The Client shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out the Client's travel bookings through Couture Reservations, LLC.
By submitting a credit card authorization form to Couture Reservations, LLC, the Client agrees to allow Couture Reservations, LLC to the provided payment method to purchase travel products from Suppliers on Client's behalf.
EXCEPT IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF COUTURE RESERVATIONS OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF COUTURE RESERVATIONS, LLC OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, COUTURE RESERVATIONS, LLC RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.
All payments for travel are due prior to departure according to each Supplier’s terms and conditions of booking.
. You understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, or in your forfeiting any monies paid for your reservations.
In some cases, there is NO REFUND once a booking is made and under deposit. You may not be entitled to a refund if you change or cancel your travel plans after confirmation of a booking.
All cancellation requests must be sent to Couture Reservations, LLC in writing. As a result of cancellation or changes to confirmed bookings, Couture Reservation’s and third-party Supplier’s cancellation penalties will apply.
Cancellation fees will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the Supplier’s refund.
DESTINATION CHANGE AND ADDITIONAL COSTS
If you desire a change to any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. Certain bookings may not be able to be changed, and you will be responsible for any increases in cost imposed by the Supplier, as well as any Couture Reservations, LLC or Supplier change fees.
All requests for changes to a booking must be made in writing to Couture Reservations, LLC.
In the event the Client changes destination(s) or dates after the initial proposal has been reviewed, Couture Reservations, LLC reserves the right to charge an additional planning fee for further research and planning time invested.
All fees will be communicated clearly to the Client.
TRAVEL PROTECTION & INSURANCE
It is the Client's sole responsibility to obtain suitable insurance coverage for their travel plans.
Couture Reservations LLC may assist in providing information to the Client and recommending policy types based on personal experience, but Couture Reservations LLC is not authorized to give insurance advice. The Client acknowledges that any recommendations provided by Couture Reservations are based on personal experience and preferences and should not be considered as professional advice. The Client understands that they should consult with a licensed insurance advisor to determine the most appropriate coverage for their specific needs.
Couture Reservations LLC shall not be liable for any losses or damages incurred due to the Client's failure to obtain adequate insurance coverage or reliance on recommendations provided by Couture Reservations LLC.
The Client acknowledges that the recommended insurance policy may not cover all of their preferences or specific requirements. It is the Client's responsibility to carefully review the Terms and Conditions of the policy to ensure it meets their needs.
In the event of a claim, it is the Client's responsibility to submit the claim directly to the insurance provider according to the procedures outlined in the policy. Couture Reservations LLC shall not be held responsible for any delays, denials, or disputes related to insurance claims.
TRAVEL DOCUMENTS
In order to book international travel with Couture Reservations, LLC, each individual Client agrees to ensure their passport remains valid for a minimum of six months beyond the date of travel. Each Client is fully responsible for obtaining and verifying all essential travel documents, including passports, visas, health certificates, vaccinations, and any other required permits before their departure. Couture Reservations, LLC will not be held responsible for any adverse consequences arising from a Client's failure to comply with travel document requirements. It is of the utmost importance that each Client adheres to the guidelines to facilitate a seamless and enjoyable experience.
It is the responsibility of each Client to obtain and carry a valid passport book, visa(s), and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS)advise that everyone carry acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/ and examples include DHS-designated enhanced driver’s license, US passport, or a foreign government passport.
The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on your tickets and booking records. You acknowledge that it is your responsibility to ensure that the information on your tickets and confirmations is accurate. Any discrepancy between your reservation and your travel documentation may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss your flight, and any subsequent scheduled travel bookings on cruises and tours.
WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT TALES OF A TRAVEL BAG IMMEDIATELY IF CHANGES OR CORRECTIONS ARE REQUIRED. IF YOU HAVE NOT NOTIFIED US OF NECESSARY CORRECTIONS TO YOUR RESERVATION WITHIN TWENTY-FOUR (24) HOURS OF RECEIVING YOUR TRAVEL DOCUMENTS, COUTURE RESERVATIONS, LLC BEARS NO RESPONSIBILITY FOR ANY ADDITIONAL COSTS ASSOCIATED WITH MAKING NECESSARY CORRECTIONS.
TRAVEL PARTY OF TWO OR MORE
For travel arrangements involving more than one individual, the term "Group" and "Party" refers collectively to all individuals included in the booking. Each member of the Party is responsible for ensuring their passport remains valid for a minimum of six months beyond the date of travel, and for obtaining and verifying all essential travel documents, including passports, visas, health certificates, vaccinations, and any other required permits before departure.
Couture Reservations, LLC will not be held responsible for any adverse consequences arising from the failure of any member of the Party to comply with these travel document requirements. It is the responsibility of the Party organizer to communicate these guidelines to all members of the Party and ensure their adherence to them.
GROUP BOOKINGS
For Group Bookings arranged by Couture Reservations, the term "Client" refers to the group organizer or representative who is responsible for coordinating the booking on behalf of the Party. The group organizer is responsible for ensuring all members of the Party meet the necessary travel document requirements, including passport validity, visa regulations, health certificates, vaccinations and any other required permits or documentation.
Couture Reservations will not be held responsible for any sadverse consequences arising from the failure of any member of the Party to comply with these requirements. It is the responsibility of the Party organizer to communicate these guidelines to all members of the Party and ensure their adherence to them.
TRAVEL ADVISORIES
Couture Reservations, LLC will make reasonable efforts to advise the Client to regularly check travel advisories issued by the U.S. Department of State and any other relevant sources for updated information on travel restrictions, warnings, and alerts for their destination.
The Client acknowledges that it is their sole responsibility to stay informed about travel advisories and to assess the risks associated with their travel destination. Couture Reservations, LLC strives to provide accurate information, however, it is the sole responsibility of the Client to stay informed about any existing advisories. The Client agrees to independently check travel advisories prior to booking, before and during travel. Couture Reservations, LLC shall not be held liable for any consequences resulting from the Client's failure to heed travel advisories or warnings issued by authoritative sources.
The Client acknowledges that Couture Reservations, LLC provides recommendations and guidance based on available information, but are not responsible for the actions or decisions of the Client in relation to travel advisories.
Couture Reservations, LLC shall not be liable for any consequences resulting from the Client choosing to travel against the advisories listed by authoritative sources, including but not limited to:
Travel disruptions or cancellations due to sudden changes in regulations or entry requirements may result in additional expenses for the client, such as rebooking fees, accommodation costs, or alternative transportation expenses.
Financial losses incurred from non-refundable bookings or cancellations due to travel advisories may include costs associated with flights, accommodations, tours, or other prepaid expenses that are not reimbursed by travel insurance or service providers.
Medical expenses or emergencies arising from travel to areas under travel warnings or restrictions may require costly medical treatment, hospitalization, or evacuation, which may not be covered by the Client's travel insurance or may result in out-of-pocket expenses.
Legal issues or complications related to non-compliance with local regulations or restrictions may result in fines, penalties, deportation, or legal proceedings, which may incur significant expenses for the client, including legal fees, fines, or compensation payments.
CHANGES TO ITINERARY
In the event of changes to the Client's travel itinerary, including but not limited to changes in travel dates, destinations, or accommodations, the Client should promptly inform Couture Reservations, LLC. Changes are subject to availability and the policies of the respective service providers, and additional fees may apply.
Couture Reservations, LLC will make reasonable efforts to accommodate the Client's requested changes, but cannot guarantee availability or the ability to make changes without the Client incurring additional costs.
The Client acknowledges that changes to the itinerary may result in additional expenses, including but not limited to rebooking fees, fare differences, or penalties imposed by service providers.
Couture Reservations, LLC shall not be held liable for any financial losses or inconvenience incurred by the Client as a result of changes to the itinerary, including but not limited to non-refundable bookings, missed connections, or other related expenses. It is the Client's responsibility to carefully review and understand the terms and conditions of their booking.
LIABILITY
Couture Reservations, LLC acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. While we make every effort to ensure the accuracy and quality of the services offered, we are not liable for any injury, loss, damage, or inconvenience caused by third party service providers, including but not limited to airlines, hotels, transportation companies.
The Supplier may determine that alterations in itinerary are necessary for any number of reasons, including but not limited to severe weather. Any alterations to an itinerary are at the sole discretion of the Supplier, and Couture Reservations, LLC bears no responsibility for any changes.
BECAUSE TTB ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT COUTURE RESERVATIONS, LLC IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. COUTURE RESERVATIONS, LLC HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH COUTURE RESERVATIONS, LLC, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATION AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, OR CESSATION OF OPERATIONS AND OTHER MATTERS OUTSIDE OF THE CONTROL OF COUTURE RESERVATIONS, LLC, AND YOU HEREBY EXONERATE COUTURE RESERVATIONS, LLC FROM ANY LIABILITY WITH RESPECT TO THE SAME.
COUTURE RESERVATIONS, LLC HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM COUTURE RESERVATIONS, LLC WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY COUTURE RESERVATIONS, LLC.
Any claim against Couture Reservations, LLC must be brought within 12 months after the date of the completion of the trip and not later. Couture Reservations, LLC shall not, in any case, be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages. You agree that you may only bring claims in your individual capacity and not as plaintiffs or class members in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. You expressly agree to waive and forego any and all rights to bring any such class actions, purported or proposed class actions, or representative actions.
CHILDREN
All children under 18 must be accompanied by an adult. Accompanying adults are responsible for the safety of their children including providing any necessary safety equipment (such as infant/child seats) where appropriate. If a person under the age of 18 years will be travelling with an adult other than his/her parents, or with only one parent, a notarized letter written by the parents, or non-travelling parent, granting authorization to travel, including the dates of travel should be carried.
FORCE MAJEURE
Couture Reservations, LLC will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of Couture Reservations, LLC. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.
In addition, each Supplier of Couture Reservations, LLC have terms and conditions which include Force Majeure provisions. In the event that a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier pursuant to their policies, although Couture Reservations, LLC shall use its reasonable efforts to secure reimbursement for you where possible.
